1. Introduction

These Terms and Conditions ("Terms") govern your use of the D-host platform, operated by D-host Ltd, a company registered in England & Wales under company number 17251441. By accessing or using our platform at https://d-host.co.uk, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. Definitions

"Platform" means the D-host website, mobile application and related services.

"Host" means a property owner or manager who lists accommodation on the Platform.

"Guest" means a person who searches for, enquires about, or books accommodation via the Platform.

"Listing" means a property advertisement published on the Platform by a Host.

"Booking" means a confirmed reservation made between a Guest and a Host via the Platform.

3. Eligibility

You must be at least 18 years old to use the Platform. By registering an account, you confirm that all information you provide is accurate, current and complete. You are responsible for maintaining the confidentiality of your account credentials.

4. The Platform's Role

D-host Ltd acts as a technology intermediary connecting Hosts and Guests. We do not own, manage, control or inspect any listed properties. The contract for accommodation services is formed directly between the Host and the Guest. D-host Ltd is not a party to that contract and accepts no liability for the conduct of Hosts or Guests, or for the condition, safety or suitability of any property.

Except where expressly stated, D-host Ltd does not independently verify, inspect, guarantee or endorse any property, Host or Guest. Users use the Platform at their own risk and are responsible for conducting their own checks before entering into any agreement or booking.

5. Host Obligations

By listing a property on D-host, you confirm that:

You have the legal right to rent the property and all necessary permissions, licences and consents are in place.
All information in your Listing is accurate, up to date and not misleading.
You will honour confirmed Bookings except in cases of genuine emergency.
Your property complies with all applicable UK health, safety and housing legislation.
You are solely responsible for setting your own pricing, availability and house rules.
You will handle any disputes with Guests directly and in good faith.

6. Guest Obligations

By making a Booking, you confirm that:

All personal information provided is accurate and complete.
You will treat the Host's property with respect and comply with house rules.
You will not exceed the maximum occupancy stated in the Listing.
You accept sole responsibility for any damage caused during your stay.

7. Payments

Payments on the Platform are processed securely by Stripe, Inc. By submitting payment details, you agree to Stripe's terms of service. D-host Ltd does not store card numbers or sensitive payment data. All prices displayed are in GBP. D-host Ltd reserves the right to charge a platform service fee, which will be clearly disclosed prior to booking confirmation.

8. Cancellations and Refunds

Each Listing may specify its own cancellation policy. The applicable policy will be clearly displayed before you confirm a Booking. Refunds, where applicable, will be processed within 5-10 business days via the original payment method. In the event of a dispute regarding a cancellation, both parties should attempt to resolve the matter directly before contacting D-host support.

9. Prohibited Conduct

You must not use the Platform to:

Post false, misleading or fraudulent Listings or reviews.
Circumvent the Platform to arrange payments outside of the booking system.
Harass, threaten or discriminate against any other user.
Upload malicious code or attempt to interfere with the Platform's operation.
Use the Platform for any unlawful purpose.

D-host Ltd reserves the right to suspend or permanently ban any account found to be in breach of these prohibitions.

10. Intellectual Property

All content on the Platform, including but not limited to text, logos, graphics, software and design, is the property of D-host Ltd or its licensors. You may not copy, reproduce, distribute or create derivative works without our prior written consent. By submitting content, such as Listing descriptions or photos, you grant D-host Ltd a non-exclusive, royalty-free licence to display that content on the Platform.

11. Limitation of Liability

To the fullest extent permitted by UK law, D-host Ltd shall not be liable for:

Any indirect, consequential, special or incidental losses.
Loss of profits, revenue or data.
Any loss or damage arising from a Host's or Guest's conduct.
Any failure or delay outside our reasonable control.

Our total aggregate liability to you shall not exceed the platform service fee paid by you in the 12 months preceding the claim.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability which cannot be excluded under applicable law.

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, that the Platform will be uninterrupted, error-free or free from viruses. We do not warrant the accuracy or completeness of any Listing content.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

Hiring

Terms & Conditions for hiring

Hot tub hire

Hot tub hire is subject to safe access, suitable level ground, electricity and water availability, and D-host approval.

A booking deposit is required before the booking is confirmed. The booking deposit forms part of the total hire price and is non-refundable if the booking is cancelled by the customer.

A refundable security deposit is payable on delivery. It will be returned on collection after inspection, provided there is no damage, missing equipment or excessive cleaning required.

Customers are responsible for following all safety instructions during the hire period.

D-host shall not be liable for any injury, illness, allergic reaction, accident, property damage or loss arising from misuse of the equipment, failure to follow safety instructions, unsuitable site conditions, or third-party actions, except where caused by D-host's negligence or where liability cannot be excluded under applicable law.

If the booking deposit is not paid in time, the booking may be cancelled and the dates may be released.

2. What Data We Collect

We collect the following categories of personal data:

Account data: name, email address, phone number, profile photo.
Host data: property address, bank account details via Stripe, listing content and photos.
Booking data: booking dates, guest numbers, payment records, correspondence.
Technical data: IP address, browser type, device information, pages visited, session data.
Analytics data: usage statistics collected via Google Analytics.
Communications: messages sent through our messaging system, support enquiries.

3. Legal Basis for Processing

We process your personal data on the following legal bases under UK GDPR:

Contract performance, Article 6(1)(b): to create and manage your account, process bookings and handle payments.
Legal obligation, Article 6(1)(c): to comply with our obligations under UK law, including tax and financial record-keeping.
Legitimate interests, Article 6(1)(f): to improve the Platform, prevent fraud, ensure security and send relevant service communications. We have assessed that these interests do not override your fundamental rights.
Consent, Article 6(1)(a): for non-essential cookies and marketing emails. You may withdraw consent at any time.

4. How We Use Your Data

We use your data:

To create and manage your account.
To process bookings and payments via Stripe.
To facilitate communication between Hosts and Guests.
To send transactional emails, including booking confirmations, receipts and alerts.
To send marketing emails, where you have opted in.
To analyse Platform usage and improve our services.
To detect and prevent fraud, abuse and policy violations.
To comply with legal obligations.

5. Data Sharing

We share your personal data only with:

Stripe, Inc. for payment processing. Stripe is PCI-DSS compliant. See stripe.com/privacy.
Google LLC for analytics via Google Analytics. Data may be transferred to the US under Standard Contractual Clauses.
Hosting and infrastructure providers who process data on our behalf under Data Processing Agreements.
Regulatory authorities or law enforcement where required by law.

We do not sell your personal data to third parties.

6. Data Retention

We retain data for the following periods:

Account data: retained for the duration of your account, plus 6 years after closure for legal compliance.
Booking and payment records: 7 years for HMRC requirements.
Support communications: 3 years from last contact.
Analytics data: retained per Google Analytics default settings, up to 26 months.
Marketing consent records: until you withdraw consent, plus 1 year.

After these periods, data is securely deleted or anonymised.

7. Google Analytics

We use Google Analytics to understand how visitors use our Platform. Google Analytics collects data such as pages visited, time spent on site, browser type and approximate location at country or city level. This data is aggregated and does not directly identify you.

You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout, or by declining analytics cookies in our cookie banner.

8. International Transfers

Some of our service providers, including Google and Stripe, are based outside the UK. Where personal data is transferred to countries outside the UK, we ensure appropriate safeguards are in place, such as UK-approved Standard Contractual Clauses or adequacy decisions by the UK Government.

9. Your Rights

Under UK GDPR, you have the following rights:

Right of access: to request a copy of the personal data we hold about you.
Right to rectification: to request correction of inaccurate or incomplete data.
Right to erasure: to request deletion of your personal data in certain circumstances.
Right to restriction: to request that we limit how we process your data.
Right to data portability: to receive your data in a structured, machine-readable format.
Right to object: to object to processing based on legitimate interests or for direct marketing.
Right to withdraw consent: where processing is based on consent, you may withdraw at any time without affecting the lawfulness of prior processing.

11. Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure or destruction. These include HTTPS encryption, access controls and regular security reviews.

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by displaying a prominent notice on the Platform. The updated policy will be effective from the date it is posted.

_gid: set by Google Analytics. Used to distinguish users. Expires after 24 hours.
_gat: set by Google Analytics. Used to throttle request rate. Expires after 1 minute.
